Regulatory changes and common violations in the deposit area cause trouble for many institutions. The deposit area has seen recent changes to long-standing regulations; notably, Regulation CC limits have been adjusted, Regulation D reserve requirements have been reduced to zero, and Regulation D transaction limits have been removed. On top of these changes, there are common violations to avoid. Every month the regulatory agencies publish lists of enforcement actions taken against financial institutions. Enforcement actions can include civil monetary penalties, consent decrees and cease and desist orders, to name a few. Every enforcement action is a lesson to be learned by other financial institutions – the actions required to cure the problems in one institution are the actions required in other institutions to avoid the same problem.
Become aware of the regulatory changes and common violations before they become a problem. Ensure you’ve adjusted for recent regulatory changes. Use recent enforcement actions and common violations to determine if the same problem exists in your institution. If the problem is present, self-detection and prompt corrective action generally results in less severe penalties; if the problem does not exist, take a few simple steps (policies, procedures and training) to ensure the problem doesn’t occur in your institution.
