Do not for a second think we ended the war and the military rules no longer matter. I recently got this question from a small community bank, “For the second time in 3 years we have an SCRA request. Our customer called Friday and said they were going to basic training on Monday. I don’t have orders. There was a different compliance officer the last time, What do I do, help?” It’s purely academics until it’s your question. The answer was, “take a breath, let’s talk it through, it’s all ok.”

Whether you like it or not your bank has a military mission because the servicemembers who bank with you are as good as a protected class of borrowers. If you say “we don’t have servicemembers,” while you may be correct today, will that be a correct statement tomorrow, do you know if any customers enlisted yesterday or were called to active duty?

Regardless, your examiners want to see procedures so you’ll know how to react when you do have one or a hundred. When making a covered loan, you need to know who is in the military or a qualified dependent. So who are these borrowers and what’s a covered loan? In this webinar, Andy will discuss the rules and how to comply with them to avoid violations of the law.

Many military lending enforcement actions are not against banks, but some are. You have risk. Your examiners want to see complete compliance. That means clearly understanding the compliance requirements of the MLA and SCRA and having effective lines of communication between affected areas in your institution, and well-designed policies, procedures, training and execution.


You want to protect your customers. You need to protect your bank. You also want to avoid problems with examiners who want to discuss policies and procedures for servicemembers.. You need to understand what your procedures must address, who must be trained, how to respond to inquiries, and more.

Andy Zavoinia

Mr. Andy Zavoina, CRCM, is an Executive Vice President and Chief Relationship Officer with the Glia Group, Inc., best known for its interest in BankersOnline.com. He joined Glia and BOL in 2003.

Mr. Zavoina has been in finance and banking for 40 years. Over 20 years were with a two-bank holding company which had $534 million in assets, 89 branches spanning Texas and nearly 500 ATMs.  He managed loan workouts, has been a consumer, commercial and real estate lender, managing those departments, as well as being his banks first Webmaster.  He was responsible for compliance -management, -auditing, and -training for both banks.

Andy is a frequent webinar presenter for BOL Learning Connect and a key contributor to conferences put on by BOL Conferences, Inc.  In addition, Andy teaches live presentations at state association schools and regional compliance organizations across the U.S.  and has served on the faculty of national banking schools.  He has written articles and lectured on many facets of compliance, the use of the internet and technology as a tool, as well as compliance in cyberspace.

Mr. Zavoina is a recipient of the American Bankers Association’s Distinguished Service Award for his involvement and accomplishments in the field of regulatory compliance management.  He is a past Chairman of the ABA’s Compliance Executive Committee, the Editorial Advisory Board for the ABA Compliance Magazine and served as a member of the ABA’s Compliance School Board. He also served on the Texas Bankers Association’s Compliance Committee.

He is a graduate of the ABA National Commercial Lending School, National Compliance and National Graduate Compliance School and is a Certified Regulatory Compliance Manager with the Institute of Certified Bankers.
